TERMS AND CONDITIONS

1. AGREEMENT TO TERMS

By accessing and using this website (hmongifts.com), you agree to be bound by these Terms and Conditions. This is a legal agreement between you and H.M.O.N.Gifts. If you do not agree to these terms, you must discontinue use of the site immediately.

2. PRICING AND PAYMENTS (MN PRICE TRANSPARENCY)

  • All-In Pricing: In accordance with Minnesota law, the prices displayed on our website include all mandatory fees. You will not be charged hidden administrative or service fees at checkout.

  • Taxes and Delivery: Sales tax and shipping costs are calculated at checkout and are not considered "mandatory fees" under MN law.

  • Payment: Payments are processed securely via Paypal, Stripe, etc. You represent that you have the legal right to use any payment method provided.

3. SHIPPING AND DELIVERY

  • Customer Responsibility: Shipping is a service provided by third-party carriers. All shipping costs are the sole responsibility of the customer.

  • Risk of Loss: The risk of loss and title for all items pass to you upon our delivery to the carrier. We are not responsible for packages stolen after confirmed delivery ("porch piracy") or delays caused by the carrier.

4. RETURNS AND REFUNDS (FINAL SALE)

  • Cost of Returns: If a return is authorized, the customer is responsible for all return shipping costs. Original shipping charges are non-refundable.

  • Condition: Items must be returned in original, unused condition with all packaging intact.

  • MN Disclosure: As required by Minnesota Statute 325F.80, please note that [Clearance/Custom Items] are FINAL SALE and are not eligible for return or exchange unless fundamentally defective.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law, H.M.O.N.Gifts shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our products. Our total liability to you for any claim arising out of your purchase shall not exceed the actual purchase price paid for the specific product at issue.

6. TERMINATION OF ORDERS

We reserve the right to refuse or cancel any order at any time for reasons including, but not limited to:

  • Product availability errors.

  • Errors in the description or pricing of the product.

  • Suspicion of fraud or unauthorized/illegal transactions.

  • Violations of these Terms and Conditions.
    If your order is cancelled after payment has been processed, we will issue a full refund to your original payment method.

7. GOVERNING LAW

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles. Any legal action shall be brought exclusively in the courts located in Anoka County, Minnesota.
